Looks like there is a new way to verify ones existence now!

Visit https://www.realme.govt.nz/ to see what this is all about.

An excerpt from the above site states:-

"Welcome to the RealMe® service, the new secure way for New Zealanders to access services and prove their identity online. Backed by the government and New Zealand Post, the RealMe service has been designed to be trusted by business. The RealMe service allows you to prove who you are online so you can do more from anywhere. And, it’s free to consumers."This may be interesting for lawyers and as to whether this would be an acceptable form of verification for Land online or other client identification purposes. 

I understand the Banks in particular are really putting the burden lawyers to verify and ID clients when meeting up, especially for new clients.  Current acceptable forms of valid ID are drivers license, passport and other tax invoices or utility bills confirming the names of the person which also puts an address to the name.

To be a "RealMe" you will need your mobile phone/ number, and your New Zealand passport.  If you don’t have a New Zealand passport you'll need your New Zealand citizenship certificate, or your New Zealand birth details, or your overseas passport and visa details.

I will check and report back if this becomes and official verification tool soon! Watch this space.

Anti-Money Laundering and Countering Financing of Terrorism Act 2009

The Anti-Money Laundering and Countering Financing of Terrorism Act 2009 ("the Act") comes into force on 30 June 2013. 

The New Zealand Government has issued a press release at: http://www.beehive.govt.nz/release/internal-affairs-combats-money-laundering.

Financial institutions and other reporting entities are caught by the stringent requirements, compliance procedures and ongoing obligations as outlined under the Act.

You may have a quick look at the Act to get a feel for the seriousness and implications of non compliance at: http://www.legislation.govt.nz/act/public/2009/0035/latest/DLM2140720.html. 

For instance the reporting entity will be required to carry out a customer due diligence to iron out any potential for breach under the Act.  There are also record keeping requirements.

It may be a good idea to look out for seminars and workshops to enhance ones understanding of the statutory requirements and obligations to avoid penalties and conviction under the Act.  Interestingly, the Act allows for both criminal and civil enforcement which may be run concurrently with exceptions.

Section 118 of the Act outlines the powers under the search warrant and obligations of a person who is called upon to assist with searches.

The above summary shows the Act may have serious application to both individuals as well as businesses.
